General Terms and Conditions of "Member gets Member"
1. Terms & conditions
The Program is accessible via www.scarlet.be/refer-a-friend. Access and use of the Program is governed by these General Terms and Conditions. By using the Program, you fully and unconditionally accept these Terms and Conditions. Users are deemed to be cognizant with the content of these Terms and Conditions. The Program is reserved for private and non-commercial use.
2. Eligibility
The Godfather must be a Scarlet consumer customer (professional clients are excluded from receiving rewards). Godfathers who are in default of payment are excluded from the Program and are not allowed to receive any Reward.
The Godchild who already have active Scarlet products are excluded from the Program. The Godchild can be a professional or consumer.
3. Principles and Rewards
The reward is given in the form of a credit note on the Scarlet invoice. If the Godfather decides to end their Scarlet subscription and has not yet benefited from the deduction of their credit, they will lose their remaining credit.
If the credit granted is greater than the next invoice, the remaining credit will be deducted from the next invoice.
Only the Godfather is eligible to receive a Reward. No reward is granted for the Godchild. The order of the Godchild must be completed, and all products must be installed before the Reward is granted. The Godfather will receive a Reward based on the new product(s) bought by the Godchild in the Program:
- 10 € for new mobile subscription
- 10 € for new fixed line subscription
- 10 € for new TV subscription
- 20 € for new internet subscription
No Reward will be granted for any options or upgrades to existing plans. The Reward will be automatically credited to the Godfather's next bill after the Godchild's products have been successfully installed and activated. This means that once the Godchild completes the installation and activation process, the corresponding Reward amount will be deducted from the Godfather's subsequent invoice. If the Reward amount exceeds the total of the next invoice, the remaining credit will be carried over and deducted from subsequent invoices until the full Reward amount has been applied.
The Godchild must use the same email address as referred by the Godfather in the referral form to order their new Scarlet products to receive the reward. If the Godchild has purchased products before the Godfather submitted the referral, the Reward will not be granted.
There is a maximum amount of €120 per year for the received Rewards. If more than one Godfather references the same Godchild, only the first one who referred the Godchild will receive the corresponding Reward.
The Godchild must place their order within 30 days of the Godfather submitting the referral webform. If the order is not placed within this 30-day period, the Godfather will not be eligible to receive the Reward. The Godchild must add the email address used in the webform of the Godfather so that this email address is the link to the lead email address.
4. Identification
The identity of the Godfather and Godchild are determined on the basis of the data they provide. Scarlet can under no circumstances be held liable if the identification of a User is impossible due to incorrect or incomplete data being provided by the latter. The use of false data will result in the exclusion of the Godfather/Godchild.
5. Liability
Within the limits provided for by the laws in force, Sc declines all liability in the event of claims, penalties, loss, damage or expenses incurred in connection with the use of the Service. The liability of Proximus is excluded with regard to immaterial or indirect damage such as loss of profit, and loss or corruption of data. Nothing in these General Terms and Conditions excludes the liability of Proximus for its own intention or for any other form of liability that cannot be excluded or limited under applicable mandatory laws.
In the event of fraud, misuse, bad faith and/or non-compliance with these General Terms and Conditions or other Proximus general conditions, Scarlet has the right to take any appropriate administrative action and/or legal action, inter alia, to suspend or exclude Godfather/Godchild.
6. Modification and termination
Proximus may terminate the Service at any time, upon simple notification to the user by e-mail, without notice or compensation being due.
Proximus is authorized to amend these General Terms & Conditions at any time. In that case Proximus shall notify the Users thereof by e-mail or via notification in the application and specify the date as from when the amended General Terms and Conditions will enter into effect. If no date is specified, the amendments shall apply as soon as a User is informed or becomes aware of the amendments. Users who do not accept these changes may terminate their use of the Program immediately and free of charge.
7. Personal Data
Personal data will be processed in accordance with the Privacy policy of Scarlet.
